Welcome to Kaphost! This document outlines the detailed terms and conditions under which Kaphost operates. By using our services, you agree to these terms and conditions in full. Please review this document thoroughly, as it constitutes a legally binding agreement.
1. DEFINITIONS
- “We,” “Us,” “Our”: Refers to Kaphost Hosting, its employees, and subsidiaries.
- “Customer,” “Client,” “You”: Refers to any individual, organization, or entity utilizing our services.
- “Services”: Includes web hosting, domain registration, email services, and any other services provided by Kaphost.
- “Agreement”: Refers to this Terms and Conditions document, as amended periodically.
2. ACCEPTANCE OF TERMS
By accessing and using Kaphost’s services:
- You confirm that you are at least 18 years old or have obtained parental consent.
- You have read, understood, and agree to all terms outlined herein.
- You agree to comply with all applicable laws and regulations, including international, national, and local laws governing online activity.
Failure to comply with these terms may result in suspension or termination of your account and services.
3. ACCOUNT CREATION AND SECURITY
- Account Information:
- You are required to provide accurate, current, and complete information during registration.
- Any falsified or misleading information may result in immediate suspension.
- Security Responsibilities:
- You are solely responsible for safeguarding your account credentials.
- Any unauthorized access resulting from your negligence will not be the liability of Kaphost.
- Account Maintenance:
- Kaphost reserves the right to request additional verification at any time to ensure the security and integrity of accounts.
4. PAYMENT TERMS
- Billing Cycle:
- Services are billed monthly, annually, or as per the agreed term. Invoices are generated 7 days before the due date.
- Grace Period:
- Payment is due by the invoice due date.
- If payment is not received within 4 days after the due date, your account will be suspended.
- If payment remains overdue for 7 days after suspension, your account will be terminated permanently.
- Late Fees:
- A late fee of 50BDT may apply to overdue payments.
- Refund Policy:
- Refunds are provided only for hosting plans within the first 30 days under the Money-Back Guarantee.
- Domain registration, SSL certificates, and add-on services are non-refundable.
- Reactivation Fee:
- A reactivation fee of 500BDT will apply if an account is reinstated after suspension or termination.
5. SERVICES AND USAGE
5.1 Web Hosting Services
- Hosting plans are provided based on specific resource limits (e.g., bandwidth, disk space). Customers exceeding these limits may face additional charges or service limitations.
- Resource overuse, including CPU or RAM abuse, is strictly prohibited and may lead to immediate suspension.
5.2 Domain Registration
- Domain availability is contingent upon third-party registrars. Kaphost does not guarantee successful registration until confirmed.
- Renewal of domains is the sole responsibility of the customer. Domains not renewed on time may result in expiration and loss of ownership.
5.3 Email and SMTP Services
- Email services are to be used for legitimate business purposes only.
- Sending unsolicited emails (SPAM), engaging in phishing, or any illegal activity will result in immediate suspension without refund.
6. ACCEPTABLE USE POLICY (AUP)
You agree not to engage in the following:
- Hosting content that is illegal, defamatory, obscene, or harmful.
- Activities that promote spamming, hacking, or distribution of malware.
- Violations of intellectual property rights or any copyright infringement.
Kaphost reserves the right to investigate and act upon any violations, including suspension or termination of services without notice.
7. SUSPENSION AND TERMINATION POLICY
- Suspension:
- Accounts overdue for 4 days past the invoice due date will be suspended.
- During suspension, services will be inaccessible, including hosting and email.
- Termination:
- Accounts overdue for 7 days after suspension will be terminated.
- Termination includes deletion of all data, files, and configurations without recovery.
- Restoration:
- Restoration of terminated accounts is possible only if a backup exists and is subject to additional fees.
- Voluntary Termination:
- Customers wishing to cancel services must notify us 7 days before the next billing cycle.
8. PRIVACY POLICY
- Data Collection:
- Kaphost collects personal and payment information strictly for service provision.
- Data Sharing:
- We do not share your data with third parties except for legal compliance or payment processing.
- Data Retention:
- Upon account termination, Kaphost retains the right to delete customer data after 30 days.

9. LIMITATION OF LIABILITY
- Kaphost is not liable for damages, including data loss, business interruptions, or missed opportunities, arising from:
- Customer error or misuse.
- Third-party attacks or natural disasters.
- System maintenance or technical failures.
- Total liability under this agreement is limited to the fees paid by the customer during the last billing cycle.
10. INDEMNIFICATION
You agree to indemnify Kaphost against any claims, damages, or expenses arising from your use of our services, including violations of this agreement.
11. GOVERNING LAW
These terms are governed by the laws of Bangladesh. All disputes will be resolved exclusively in the courts of [Insert Jurisdiction].
